There is no such thing as a family crest. Actually what most people call a crest is a coat of arms. A crest is part of the coat of arms

There are no laws in the United States regarding heraldry. A person is free to display one without documented proof that they are entitled to it but it is like putting up a picture of a famous person with their surname and claiming him as a direct ancestor whether they know he is or not.

Not everyone with the same surname comes from the same root. So when someone sells you a coat of arms based solely on your surname, they are not being honest if they do not tell you that you are probably not entitled to it.

Some coats of arms have the same name
which means more than one individual was granted one. There are about 200 with the surname Lewis, but that doesn't mean everyone with the surname Lewis is any way related to any of the 200 granted one, much less be a direct male line descendant.

There was a time when people did not have surnames. William son of John signed his name, if he could write, William son of John.
Eventually sons of people named John became Johnson. Robert the taylor signed his name Robert the taylor. Eventually people with the occupation of taylor took the name Taylor.

Some names are habitational based on the town a person was from or a castle, lake, bridge, river, church,etc a person lived close to. Sam that lived on a hill became Sam Hill but he wasn't the only guy living on a hill that took the name Hill.
